Welcome to Neuragram, these Terms of Use set out requirements for all of Neuragram’s users for anyone interacting with any of our online/offline properties wherever you may encounter them in the world and whether via website, blog, or mobile application (“app”). For example, these Terms of Use govern your use of our website and our app, and include, but may not be limited to, governing your use of any Neuragram Fit-Tech Private Ltd products or services: Neuragram, Neuradesign, Neuraschool use (collectively, the “Services”). If you do not agree to these Terms of Use for our Services, please do not use Neuragram services.

Neuragram is primarily for use by individuals above 13 years of age (“under 13s”). People under 13 years will require consent from a parent/mentor/guardian. Approved Neuragram staff and health consultants have access to content and account management in certain controlled, time-limited circumstances such as when they are interacting in collaboration with other community groups/group members and Group Administrators.

We want Neuragram to be great fun for all of you.

We respect the rights of every user. Our accounts are designed to be private unless specific consent has been given by a user for any services they wish to avail of from the Neuragram platform. Before using Neuragram, I agree to set up a personal account with Neuragram. Do not use Neuragram for any commercial purposes and promotional purposes unless given permission for your use of Neuragram services to Neuragram Ltd. Neuragram closely follows the letter and spirit of privacy laws in the United Kingdom, European Union, United States, United Arab Emirates, India, and everywhere that Users enroll with Neuragram. Law of the land in many regions requires us to obtain consent prior to collecting any information about you and allowing you to set up a Neuragram account. If at any point there is a government or legal restriction we may suspend or delete your account and you cannot use Neuragram’s website or app. If you want to read about our data privacy practices, please review our Privacy Policy (Annexure A).

To help us we ask for your help with our terms of use:-

You can create text, blog, emoji, tutorials, photos or videos to share on Neuragram. Everyone will be checked by our own safety and automated moderation system (NeuraSecure) as well as human moderators before they are allowed to use Neuragram. Neuragram reserves the right to moderate content before or after they are posted on the forum.

Be awesome to each other. This is a friendly and fun place to build healthy communities and to interact online. (We do not like bullies, Religious and/or Political fanatics, and extremism and will remove people from Neuragram if we become aware of people trying to use it to upset others).

You can connect with other members, who are also verified Neuragram users, and make new friends “NueraBuddies” from our lists of verified users. You can see the profile overview (name, age, and county/country) of users to support the social aspect of Neuragram. In certain circumstances, and when approved by a user “NeuraBuddy” you may also see the profile overview and their posts in specific groups outside your own groups that are part of that collaboration.

Report misbehavior, such as bullying, threats, etc. . . . Neuragram makes it easy for you to report users if you want to and it will be flagged to our team to resolve the matter within 2 days. We will not let the person know who reported them, ever. We promise. This report is anonymous and is there to help all of Neuragram’s users feel empowered to take care of themselves and others on Neuragram. We can take a series of corrective actions, which can include suspending the other user/community or removing them from the site altogether.

Artists and Creators. If you aren’t the original producer of a piece of music, literature content, or creator of a piece of art, such as a photo or video, do not share that piece of art without getting the artist’s approval prior to sharing that art with others on Neuragram. (Please do not copy someone else’s work or pretend it is yours. Someone else will have worked very hard creating it and it is his or her copyright.) We comply with the Digital Millennium Copyright Act. If you are an artist who believes that a Neuragram user has shared your copyrighted material without permission using our website or app, please contact us via email at hello@neuragram.in.

Think before you post. When you share something like a comment, an emoji, a blog, a picture or a video on the Internet or through an app or Website, including all platforms of Neuragram, that sharing is essentially permanent. While there are ways to delete some content or your account, once you have shared something with someone else, that person or group of people will always have a copy of what you shared with them in their Neuragram accounts. Therefore, we always recommend you pause for a moment before you share because the Internet creates a permanent record. Do not post anything you might later regret posting.

Respect yourself. Please do not post pictures, films, or messages that are rude, nasty, and erotic in nature, contain nudity, or could upset someone else. If you do share inappropriate images, we will report these to legal authorities as per the legal requirement of the region. In addition, remember public legal bodies and Neuragram administrators will be able to review some of the content on Neuragram so do not say or post anything that you would later be embarrassed about.

Do not do any of the following things:

  • Use someone else’s Neuragram account;
  • Pretend to be someone else on Neuragram - be your true self;
  • Share precise or real-time information about your personal information with a stranger;
  • Share your account password or login credentials with anyone one other than yourself
  • Use Neuragram to advertise another business or to sell anything;

The information, services, and products are sold or given to the user with the understanding that neither the author, seller, nor publisher is engaged in rendering any legal, business, or financial advice to the purchaser or to the general public. The views and opinions expressed are those of the authors and do not necessarily reflect the official policy or position of Neuragram.

Any content provided by our bloggers or authors is of their opinion and is not intended to malign any religion, ethnic group, club, organization, company, individual, or anyone or anything. NOTWITHSTANDING ANY DAMAGES USER MAY INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED ABOVE AND ALL DIRECT OR GENERAL DAMAGES), THE ENTIRE LIABILITY OF NEURAGRAM AND ANY OF ITS SUPPLIERS UNDER ANY PROVISION OF THIS AGREEMENT AND YOUR EXCLUSIVE REMEDY FOR ALL OF THE FOREGOING SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID FOR THE PRODUCTS, SERVICES AND INFORMATION EQUIVALENT of INR 10/- . THE FOREGOING LIMITATIONS, EXCLUSIONS, AND DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.

If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions of this Agreement will remain in effect. Neuragram has the right to modify these terms and conditions at any time.

Copyright, trademark, and other intellectual property laws protect Neuragram. Neuragram grants you a limited, non-exclusive, non-transferable license to view, copy and display Neuragram solely in connection with your permitted use of Neuragram. Any rights to our intellectual property not expressly granted are reserved. Any unauthorized use of Neuragram’s logos, trademarks, copyrights, domain names, or other distinctive brand features is prohibited.

Reverse Engineering. Neuragram is powered by the proprietary software system that we have uniquely developed to provide you with the service. Neither you as a user, nor individual, or an organization: (a) reverse engineer, decompile, or disassemble Neuragram or any of our sites, apps or software; (b) attempt to derive the source code of Neuragram; (c) permit or encourage any third party to do any of the foregoing, except to the extent permitted by applicable law in order to render software interoperable with other software, and only then after receiving the written, prior approval of Neuragram.

Limitation of Liability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NEURAGRAM OR ITS SUPPLIERS BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL, INDIRECT, OR EXEMPLARY DAMAGES WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATING TO THIS AGREEMENT OR USER’S USE OF OR INABILITY TO USE THE PRODUCTS, SERVICES AND INFORMATION, OR THE PROVISION OR FAILURE TO PROVIDE SUPPORT SERVICES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF CONFIDENTIAL OR OTHER INFORMATION, BUSINESS INTERRUPTION, PERSONAL INJURY, LOSS OF PRIVACY, FAILURE TO MEET ANY DUTY (INCLUDING OF GOOD FAITH OR REASONABLE CARE), NEGLIGENCE, COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR ANY OTHER CLAIM FOR PECUNIARY OR OTHER LOSS WHATSOEVER, OR FOR ANY CLAIM OR DEMAND AGAINST USER BY ANY OTHER PARTY, EVEN IF NEURAGRAM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions of this Agreement will remain in effect. Neuragram has the right to modify these terms and conditions at any time.

Neuragram may modify these Terms of Use from time to time. Neuragram will notify you of any changes to our Terms that materially (that means quite significantly) alter your rights or responsibilities by email and by posting a notice on our Site or in our App, as appropriate. If you continue to use Neuragram after this notification, you are consenting to those changes and agree to be bound by those changes to our Terms. Remember, you can stop using Neuragram at any time you like, but we hope you won’t.

We like you. We really do like you. But, just in case we have a disagreement, we will work together to resolve that disagreement. We want to address your grievance, or ours, without resorting to a formal legal dispute. Before filing a claim against Neuragram, you agree to try to resolve the dispute informally by contacting us by email at hello@neuragram.in. We promise to try to work out any confusion or complaint amicably. If we cannot resolve our dispute within 30 days, we can proceed to a formal legal dispute.

Laws Governing Legal Disputes and Venue

The laws of the Republic of India govern this set of Terms, as well as any dispute, claim, or controversy that may arise between you and Neuragram, despite claims to the contrary regarding conflict of law’s provisions. Should a dispute need to be adjudicated between us, the only proper venue for such a dispute will be a court of law within the state of Bihar or Kerala in India.

No Class Action or Multi-Party Lawsuits

If you have a dispute with Neuragram, you may only work to resolve that on an individual basis. You or your representative, acting on your behalf or their own, may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidations with other arbitrations are not permitted as a condition of you using our service whether free or through purchase.

Entire Agreement

These Terms, and any others, such as our Privacy Policy that we may refer to in these Terms, are the complete set of agreements between Neuragram and you as the end-user of our services. These Terms supersede and control with respect to any other agreement. If any part of these Terms is found to be unenforceable by a court or arbitrator, the remaining parts will remain in full force and effect. If Neuragram fails to enforce any part of these Terms, that failure does not constitute a waiver of our ability to enforce those provisions.

Privacy Policy

Our promise to you the user

Anything you create in Neuragram is yours, not ours (photos, films, words). You login using the account has been created for you. We do not sell any information about you to other companies for marketing or advertising. We do not currently use advertising and there is no tracking of your account for behavioral or third-party advertising in Neuragram.

To help us make sure the Neuragram technology works in the right way to keep you safe we will collect some information (data). This however is just for us to use internally for product improvement. We do not use data for research purposes.

If you want to use Neuragram, you need to give consent to the user policy first.

We have a team (moderation) who check Neuragram photos, films and words to make sure they are safer, healthier and, or kinder to try not to upset anyone. Every social interaction could be pre-moderated to keep all users as safe as possible at all times live sessions (we are working on this too though).You can wipe your account whenever you wish and you can delete your account whenever you wish. We will always try to be clear in anything we say.

If we are hacked (have a data breach), we will report all users (those affected and those not) within the same day of it coming to the attention of our CEO. We will then keep you updated on a regular basis through our website and social channels on updates to the fix. Anything we add to this list in the future we will let you know about.

Our commitment to your privacy

Privacy is of high importance to us. We need to be able to moderate all content to keep all of our users safer, healthier and kinder as can be. We also study analytics to ensure the platform is performing to the best of its ability to improve our service for you. Only those team members with appropriate security clearance, experience and training on our internal data handling procedures will have access to personal user data.

Safeguarding

The safety of every user is our priority. If there is ever any activity that causes concern for a user (sending an inappropriate message, photo or video) we will contact a person as soon as possible. If we are unable to reach the person directly in, we will contact the email provided at the time of registration. This notification will take the form of whatever is the quickest way to reach the User.

All messages are checked by our safety software and if any are deemed inappropriate they are flagged either amber or in the most serious cases red. These messages are flagged to the sender as “in moderation”.

The amber and reds then go into a checking silo and, in the most cases, do not appear to any other user. A human moderator then reviews the amber and reds. If they fail to meet our terms and conditions, the message will be declined and never seen by any other user. Other action available to the moderators includes suspending accounts. If there is ever a photo or video showing sexualized behaviour these will also be deleted from our main server, in the interests of user protection.

Our commitment to your wellbeing

In Neuragram, we care greatly about you. To ensure we’re doing everything we can to give you a safer enjoyable experience we try to screen out all bad emoji, inappropriate language (including bullying terms), inappropriate photos and videos (based on the image and the audio). Only reward the likes you give, not the ones you get – so it is not a popularity contest. In addition, we do not show how many buddies people have. Instead, you are rewarded by how nice you are to others and how many likes you give out. All your data is stored in our local servers and on Cloud servers.

To keep you safe we also ensure

Every user is verified using either an Email or a SMS registration while accounts are created. Once verified in this way and the account is set up, Users can then invite other Users to Neuragram. We treat your data with the utmost confidentiality. We will only notify authorities or law enforcement if there is a concern for your personal or emotional wellbeing and safety.

Privacy Policy

Neuragram Fit-tech Private Limited takes protecting your personal information and privacy seriously and we comply with all applicable data protection laws. The relevant data protection law will those relating to your country of residence. In general, our privacy protections are built to comply with the General Data Protection Regulations and enhance your rights in respect any personal information you share with us or that we collect about you.

We apply these protections across our users across the globe. The data protection laws of India primarily govern us, while we try to comply with the laws of other countries, we cannot guarantee that our services would comply with all the nations across the Globe and will not be legally liable outside for any legal breach by the user or us. For example, if you are a resident of India we comply with and the Data Protection Act of India protects your rights. If you reside in Afghanistan, Our services may we may be designed to comply with and your rights are protected by the local law of the land.

This Privacy Notice (“Privacy Notice”) sets out how we collect and look after your personal information when you interact with us (through the Neuragram.in website and otherwise) in accordance with the GDPR and your rights in relation to the manner in which we use your personal information. Neuragram is the data controller and responsible for your personal information referred to in this Privacy Notice. Please read this Privacy Notice carefully so you understand how we may use your personal information.

You should also make sure you read additional privacy notices (if any) that we may provide in certain specific situations, for example if you become a client or employee of Neuragram. The provision of your personal information to us is voluntary. However, without providing us with personal information, your use of our services may be impaired. For example, you will be unable to set up an account to access our service.

We may update this Privacy Notice from time to time so please check back periodically. We will take appropriate steps to notify you of significant changes by contacting you directly where we can reasonably do so and by placing a notice on our website. When do we collect personal information about you?

When you visit our website, we collect different sorts of personal information:

  • Information about how you use our website, including the pages you view and for how long, services you search for, the URL clickstream used, page response times and page interaction information (such as scrolling and clicks).

What sort of personal data do we collect and process?

The information we collect and the process can include the following information:

  • Your name and contact details, including official name, email and postal addresses, telephone numbers, social media accounts.
  • Information about your devices and use of our website (such as your IP address and geographical location).
  • Information about our services which you use or which we consider may be of interest to you.
  • Personal information you make public on our services through user-generated content in non-private posts.

If you apply for a job with Neuragram, What will we use your personal information for?

Your personal information may be used for the purposes specified in this notice and, in particular, we may use your personal information for the following purposes:

  • Providing services to you (or acquiring goods and services from you) and others and communicating with you in general.
  • Analysing and improving our services and activities (including our website).
  • Considering, evaluating and reporting on the social and environmental impact of our work.
  • Undertaking research -- exclusively using anonymized personal information -- to produce reports and insights to further advance online safety for those using our services and to share reports of the conclusions of that research with Security consultant working to further enhance online safety for our sites and services.

  • Progressing your application for a job with Neuragram and assessing your suitability for the role you have applied for.

Data Retention

We will retain your personal data only for as long as needed for the purposes we collected or processed it for, including for the purposes of satisfying any contractual, legal, accounting, reporting or taxation requirements. To calculate the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes in any other way, as well as applicable legal requirements.

When might we share your personal data?

  • When you direct us to do so, such as when you choose to interact with other users through Neuragram.
  • Sharing your personal information with our third-party suppliers when they are processing personal information on our behalf, for example, our professional advisors or IT providers.
  • Disclosing your personal information where legally required or upon request to government bodies as well as law enforcement agencies.
  • We could also merge or collaborate with other organizations and, in so doing, acquire or transfer personal information (but your personal information would continue to be used for the purposes set out above).
  • We may also share your personal data with any other companies in our group.
  • Where you are applying for a position with us, we may share your information with referees.

Security, storage of and access to your personal information:

We have appropriate and proportionate security policies and organizational and technical measures to help protect your information from unauthorized use, access, alteration or disclosure and from accidental loss or disclosure. We have in place procedures to notify you and any relevant regulator in case of a data breach where legally required to do so.

Your rights:

You have various rights in relation to your personal information held by us, although do note that some of these rights only apply in limited circumstances.

Where we rely on your consent to use your personal information, you have the right to withdraw that consent at any time. This includes the right to ask us to stop using your personal information for marketing purposes including the right to unsubscribe from our newsletter at any time. In some situations, you may also have rights to:

Request access to your personal information. You can write to us to ask for confirmation of the personal information we hold about you and to request a copy of that information. Provided we are satisfied, that you are entitled to see the personal information requested and we have successfully confirmed your identity, we will provide you with your personal information subject to any exemptions that apply.

Request erasure of your personal information where there is no good reason for us to continue processing it. At your request and where you are entitled to, we will delete your personal information from our records. In many cases, we will need to retain limited personal information about you, for example, in order to ensure we do not send you further communications.

Object to processing of your personal information where we are relying based on a legitimate interest and there is something about your specific circumstances which means you object to our processing your information on this basis. You can also object to processing where it is being undertaken for direct marketing.

Request restriction of processing of your personal information: a right to request that processing is suspended or restricted if there is disagreement about its accuracy or the reasons for its processing.

Request correction of your personal information, which we hold if you believe, is inaccurate.
